Terms of Service
These Terms of Service (“Terms”) are an agreement between you and Alex Rogers, doing business as Lucky Cluck Games (“we,” “us”). They cover our games, including Creature Colosseum, our websites and related online services (the “Services”). By downloading, accessing or playing, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or the minimum age in your country) to use the Services. If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you.
2. License to play
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and play the Services for your own non-commercial entertainment, on devices you own or control, subject to these Terms and the rules of the app store you got them from. We and our licensors own all rights in the Services, including the games, code, art, characters, cards, names and logos. You may not copy, modify, reverse engineer, resell, rent or create derivative works from the Services except as the law expressly allows.
Pre-release and test builds (for example, through TestFlight or friends testing) may be unfinished, unstable, or reset at any time, and are confidential unless we say otherwise.
3. Accounts
- You can sign in with a username and password, or with Apple, Google or Discord. You are responsible for keeping your login secure and for activity on your account.
- Give accurate information and keep it up to date. One person per account; do not share, sell, or transfer accounts.
- Player names must not impersonate others or be offensive, hateful, sexual, or infringing. We may change or remove names that break these rules.
- Guest accounts may be lost if you delete the app or change devices before linking a sign-in method.
4. Virtual currency and items
The Services may include virtual currency such as Crowns and virtual items, which may be earned in play or, in the future, bought through the Apple App Store or Google Play.
- Virtual currency and items are licensed to you, not sold. They have no cash or real-world value, cannot be exchanged for money or anything of value, and cannot be transferred or traded outside the Game.
- All purchases are final and non-refundable, except as required by applicable law or by the refund policy of the platform you bought from (Apple or Google). Refund requests for store purchases go to that platform.
- We may manage, adjust, rebalance or remove virtual currency and items, and pricing may change. Unused virtual currency may be lost if your account is terminated for breaking these Terms or the Services shut down, except where the law requires otherwise.
5. Conduct
You agree not to:
- cheat, exploit bugs, or use bots, hacks, mods, or unauthorized third-party software;
- interfere with servers, other players’ games, or matchmaking, or attempt to access accounts or data that are not yours;
- harass, threaten, or abuse other players, or post hateful, sexual, illegal, or infringing content;
- intentionally lose, collude, or manipulate matches, rankings, or stats;
- buy, sell, or trade accounts, virtual currency, or items outside the Game;
- use the Services for any commercial purpose or in violation of any law.

6. Online features and changes
Online features (accounts, cloud saves, real-time and 24-hour games, Arena and other modes) depend on third-party services and may be unavailable at times. We may update, change, suspend, or discontinue any part of the Services, including resetting test data, at any time.
7. Suspension and termination
You may stop using the Services and ask us to delete your account at any time (see Delete Account). We may suspend or terminate your access, remove content, or reset progress if you break these Terms, if required by law, or to protect players or the Services. Sections that by their nature should survive termination (ownership, virtual currency, disclaimers, limitation of liability, governing law) will survive.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PROGRESS OR DATA WILL NEVER BE LOST. Some jurisdictions do not allow these exclusions, so they may not fully apply to you.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUCKY CLUCK GAMES AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50. Nothing in these Terms limits liability that cannot be limited by law.
10. Indemnity
You agree to indemnify us against claims arising from your misuse of the Services or your breach of these Terms, to the extent permitted by law.
11. App store terms
If you got the Game from the Apple App Store, Google Play, or another store, that store’s terms also apply. Apple and Google are not parties to these Terms and are not responsible for the Game or its support, but Apple and its subsidiaries are third-party beneficiaries of these Terms for apps downloaded from the App Store and may enforce them.
12. Governing law and disputes
These Terms are governed by the laws of the State of South Carolina, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in South Carolina, and you and we consent to their jurisdiction, except where the law of your country of residence gives you the right to bring claims locally. Before filing a claim, please contact us so we can try to resolve it informally.
13. Changes to these Terms
We may update these Terms. We will change the “Last updated” date and, for significant changes, notify you in the Game or on the Website. Continuing to use the Services after changes take effect means you accept them.
